Mutual consent divorce is the most dignified and expedited legal procedure for dissolving a marriage when both spouses mutually agree that the marriage has broken down irretrievably. Under Section 13B of the Hindu Marriage Act, 1955, both parties jointly present a petition before the competent Family Court in Jaipur.
The essential prerequisites include: living separately for at least one year, mutual agreement that cohabitation is no longer feasible, and comprehensive settlement of all ancillary issues such as permanent alimony, return of Streedhan, and child custody or visitation terms.
The procedure involves the First Motion, where joint statements and settlement terms are formally recorded by the Family Court Judge. After recording the first motion, parties can apply for waiver of the statutory six-month waiting period under established Supreme Court guidelines to proceed directly to the Second Motion and final decree.
