The timeline begins when the cheque is returned unpaid by the bank. The payee must issue a formal statutory demand notice in writing within 30 days of receiving the return memo. The drawer is then given 15 days from notice receipt to make the payment. If the payment is not made, the payee must institute a criminal complaint before the Judicial Magistrate within 30 days thereafter.
